Terms of Service

These Terms of Service ("Terms") govern your use of the APN Agency OS platform ("the Service") operated by APN Prestige Group ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Description of Service

APN Agency OS provides a unified growth platform including CRM, content creation, AI-powered calling, social media management, landing page building, email marketing, and advertising tools. The Service is designed for Australian agencies and businesses operating in compliance with local laws.

3. User Responsibilities

You are responsible for: (a) maintaining the confidentiality of your account credentials; (b) all activity that occurs under your account; (c) ensuring you have proper consent to contact any individuals whose data you enter into the system; (d) complying with the Australian Privacy Act 1988, Spam Act 2003, and Do Not Call Register Act 2006; and (e) adhering to the terms of any connected third-party platforms including Meta, Google, LinkedIn, and TikTok.

4. Acceptable Use

You must not use the Service to: send unsolicited commercial messages; contact individuals on the Do Not Call Register without applicable exemptions; upload or distribute unlawful, defamatory, or infringing content; or attempt to disrupt, reverse engineer, or compromise the security of the platform.

5. Intellectual Property

All software, design, branding, and content provided by the Service remains the intellectual property of APN Prestige Group. Content you create and upload remains your property. You grant us a limited licence to process your content solely for the purpose of operating the Service.

6. Subscription and Payment

Paid plans are billed on a monthly or annual basis through Stripe. Subscription fees are non-refundable except where required by law. We may change pricing with at least 30 days notice. Overdue accounts may be suspended until payment is received.

7. Third-Party Integrations

The Service integrates with Meta (Facebook/Instagram), Google, LinkedIn, TikTok, Twilio, Microsoft, and other platforms. Your use of these integrations is also subject to their respective terms. We are not responsible for downtime, changes, or data loss caused by third-party providers.

8. Limitation of Liability

To the maximum extent permitted by law, APN Prestige Group is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you have paid in the 3 months preceding the claim.

9. Termination

You may cancel your subscription at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be retained for 30 days before permanent deletion, unless legal obligations require otherwise.
